There’s been no shortage of buzz in the vaping community about the FDA and other government agencies making yet another attempt of making it more complicated and more expensive for vapers to buy the products they want. With flawed research data and an unbelievably absurd approval process for vaping companies, it felt like all gloom and doom a few weeks ago, but that has since changed. As you may recall, the FDA approved the Vuse Solo to market and, not surprisingly, has postponed its decision on JUUL products, both of which are owned in part by…you guessed it: BIG TOBACCO! RJ Reynolds (Vuse) and Altria (JUUL) are stakeholders in these devices and they just happen to be the same companies behind Marlboro, Camel, and other global cigarette brands.

While there were countless vape products submitted for approval, only an infinitesimal number was approved to market. That prompted a handful of vape companies to appeal their denial, and currently, 27 brands are challenging the denial order in court, some of which are significant players for vape geeks. But the problem is that smaller vape manufacturers are getting left in the cold as they simply can’t afford the massive cost of litigation. However, there was a glimmer of hope that the legal system could and potentially will call out the FDA for such bonkers bias, and that came on October 26th when a panel of 3 judges in the 5th Circuit Court of Appeals called out for changing the rules and guidelines for approval amid the approval process. One judge even went so far as to call the FDA’s change of approval guidelines a “surprise switcheroo,” which could potentially lead the way for other vape companies that were previously denied market approval to get a second shot.
At Vape Tokz vape shop, we’re far from legal experts, but we do follow what goes on in the vaping community and this could be potentially damaging to the FDA’s recent efforts to regulate or ban vape products (inducing flavored disposable pods and e-liquids) or electronic nicotine delivery systems (ENDS).
