FDA Marketing Denial Orders: Vaping Wars To Endgame?

Obviously, from the title of this blog, our content writer is a BIG fan of Marvel but not a fan of the FDA’s increasing overreach when it comes to safer nicotine options for smoking and tobacco. At the same time, the FDA’s pursuit of vaping products isn’t anything new by any means. Years back, vape product manufacturers were forced into a seemingly endless wild goose chase of applications for approval to market, only to be rejected and marketing approval awarded to the BIG TOBACCO-owned vaping products. In fact, of the millions of applications from vape companies, only 23 devices have been awarded to date, and if you take a quick dive into who these companies are, it should be no surprise who’s getting approved. RJ Reynolds, Altria, and the usual suspects have been losing customers and money to smokers and tobacco users who have not necessarily opted to kick nicotine but adopt safer nicotine alternatives (i.e., vaping and non-tobacco nicotine products).

Just like most other smoke and vape shops in the Kansas City metro and around the United States, for that matter, you’ll find hundreds of options at Smoke and Vape Tokz, and if you pay close attention, you might notice that our inventory changes often. However, one thing that has not changed much other than new flavors and a few new brands is vape juice or e-liquids. Why, you ask? Because the FDA has never really gone after flavored vape liquids like they have disposable vapes and pod vaping devices like JUUL. While JUUL is still a somewhat popular option for older vapers, it has lost its luster, most likely due to the FDA and many media organizations making it the poster child for the vaping epidemic, which really isn’t a thing anymore. Even the FDA’s own numbers have shown a sharp decrease in people under the age of 21 using vaping products in the past few years, yet their conquest rolls on.
While most of the content we publish at Smoke and Vape Tokz in Kansas City is lighthearted, fun, and relevant to what’s going on in the metro, we feel that it is also our job to inform our customers about what is happening in the vaping industry, and what we see is very concerning. In the past few weeks, the FDA has made some rather odd and unforeseeable moves that could potentially reveal their overall endgame to squash vaping companies and put big tobacco back on top. It’s not uncommon for us to get alerts about the FDA posting MDO (Marketing Denial Orders) for flavored vaping products, but recently, they denied several vape companies and vaping devices that literally contain no nicotine at all. SMOK and Suorin are two companies that do not manufacture nicotine in any way, shape, or form. They do, however, manufacture refillable vaping devices, which leads to the question, why won’t these be denied? The answer is simple and appalling. Remember earlier when we mentioned that the FDA had never gone after vape juice or e-liquid brands? Well, it would be tough for these companies to remain in business if there were no devices to vape them. The FDA appears to be systematically cutting the heads off of vape device companies, knowing very well that the vape juice/e-liquid companies will fall like dominos soon after. The vaping wars have now turned to the endgame, which means unless something happens quickly, the choices will be to either go back to smoking or continue vaping with one of Big Tobacco’s ‘approved’ vaping devices.
The FDA’s supposed purpose is to act in the interest of public health, but if that were indeed the case, why are cigarettes still “approved to market” while scientifically proven safer alternatives like vaping are on the chopping block?
